Terms of Service

1. Accepting these terms

By creating an account or using Wishd, you agree to these terms. If you do not agree, do not use the service. We may update these terms from time to time and will note the date above. Continued use after a change means you accept the updated terms.

2. Who can use Wishd

• You must be at least 13 years old, and at least 16 in jurisdictions where that is the local minimum.
• You need a working phone number to sign in.
• You agree to provide accurate information and to keep your phone number current.

3. What Wishd is, and is not

Wishd is a registry. We help you publish a wishlist, share it, and keep track of who claimed what. We are not a marketplace, payment processor, or escrow service.

• When a guest claims an item, they go and buy it themselves. Wishd records the claim, not the purchase.
• When a guest contributes to a cash pool, they pay you directly using your chosen handle (UPI, bank transfer, card, or similar). Wishd records the amount you tell it. Wishd never holds, transfers or refunds money.
• You are responsible for confirming that you have actually received any contribution before marking it as paid.

4. Your account

You are responsible for what happens under your account. Keep your phone secure and do not share your one-time login codes. If you suspect someone else has accessed your account, contact us at [email protected].

5. Your content

You keep all rights to the events, item lists, photos and notes you post on Wishd ("your content"). You grant Wishd a worldwide, non-exclusive, royalty-free licence to host, store, display and transmit your content as needed to run the service. This licence ends when you delete your content, except where we need to keep limited copies for backup, fraud prevention or legal reasons.

You promise that your content does not infringe anyone else's rights and is not illegal, deceptive, or harmful.

6. Acceptable use

Do not use Wishd to:

• Post anything illegal, hateful, harassing, or sexually explicit.
• Solicit money under false pretences, run a charity or fundraiser you are not authorised to run, or impersonate someone else.
• Send spam over WhatsApp or SMS using Wishd messaging features.
• Try to break, scrape, reverse engineer, or overload the service.
• Use Wishd in any way that would violate the rules of WhatsApp, Meta, or any other partner platform.

We may suspend or close accounts that break these rules, with or without notice depending on the severity.

7. Guests and event links

When you share a Wishd event link, anyone with the link can open the page and see what is on it. Do not put anything on an event page that you would not be comfortable making semi-public. We provide tools to limit visibility of payment handles to claimers only, but the event page itself is link-shareable by design.

8. WhatsApp and SMS

Wishd uses WhatsApp (through Interakt, a Meta Business Solution Provider) and SMS to deliver invite links, login codes and thank-you messages. Standard message rates from your carrier may apply. You can opt out of non-essential messages by replying STOP. Login codes are essential and cannot be opted out of while your account is active.

9. Payments, taxes and gifts

Wishd does not process payments. Any contribution recorded in Wishd is a private arrangement between the host and the guest. You are responsible for any tax, reporting or legal obligations that arise from the gifts or contributions you receive. Wishd does not provide tax or legal advice.

10. Third-party services

Wishd links to and integrates with third-party services (for example, WhatsApp, Google sign-in, payment apps you choose to use). We are not responsible for those services. Your use of them is governed by their own terms.

11. Service availability

We try to keep Wishd available and fast, but we provide it on an "as is" and "as available" basis. We do not guarantee uninterrupted service, and we may change, suspend or discontinue features at any time.

12. Disclaimers

To the maximum extent allowed by law, Wishd is provided without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be error-free, secure, or that any information will be accurate.

13. Limitation of liability

To the maximum extent allowed by law, Wishd, its founders, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost gifts, lost contributions, or loss of data, arising out of your use of the service. Our total liability for any claim relating to the service is limited to one hundred United States dollars (USD 100) or the equivalent in your local currency.

14. Indemnity

You agree to indemnify and hold Wishd harmless from any claim, loss or expense (including reasonable legal fees) arising from your use of the service, your content, or your breach of these terms.

15. Termination

You can stop using Wishd at any time and ask us to delete your account by emailing [email protected]. We may suspend or terminate your account if you breach these terms or use the service in a way that creates risk for us or other users.

16. Governing law

These terms are governed by the laws of India, without regard to its conflict of law principles. The courts of Bengaluru, Karnataka, will have exclusive jurisdiction over any dispute, except where local consumer law gives you a mandatory right to bring proceedings in your home country.
